At Sena Technologies, Inc. (“we,” “us,” or “Sena”), we respect the privacy of everyone who uses our websites, applications, and other online products and services. This privacy policy (“Privacy Policy”) explains the types of information that we collect about you, how we may use and share it, and the choices you have regarding our use of that information.
You acknowledge that this Privacy Policy is part of our Terms of Use (the “Terms”) (available at www.sena.com/en-us/terms-of-use). Capitalized terms not otherwise defined in this Privacy Policy shall have the same meaning as defined in the Terms.
BY ACCESSING AND USING OUR SERVICES, YOU AGREE TO BE BOUND BY ALL OF TERMS AND CONDITIONS SET FORTH IN THIS POLICY. If you do not agree to these terms, please do not access or use our Services. As used herein, the term “Service” or “Services” includes our websites, content, applications, and other online products and services where this Privacy Policy is posted (including products, interactive features, events, newsletters, advertisements, and other services).
We may update to this Privacy Policy from time to time (See Section 14 “Changes to this Privacy Policy”). Please review it periodically to stay informed. Your continued access and use of our Services after we revise this Privacy Policy is deemed as your acceptance of those changes.
1. Information We Collect
We collect various types of information from and about users of our Services, including personally identifiable information and technical and usage information.
A. Information You Provide to Us: When you engage in certain activities within our Services (such as registering a user account, downloading or using our apps, making a purchase, registering your products, subscribing to our newsletters, posting content, or participating in promotional events), we may ask you to provide certain information about yourself by completing an online form. Participation in these activities is entirely optional, but if you choose to engage, we may request and collect your personal information from you, including:
your name, mailing address, e-mail address, phone number, and other personally identifying information;
your Sena account information, including username and password and other login details;
billing information, such as your name, address, phone number and payment information (e.g., credit card number);
your inquiry or feedback, including any information or data that you provide when contacting us, such as your name, e-mail address, country, preferred language, purchase details, and any issues related to your purchase or service; and
any other information you choose to provide.
B. Information We Collect When You Use Our Services: When you use our Services, we may use collect certain information through automated means, including:
your use of our Services, including app features used, pages visited, referring and exit pages, and search queries;
precise geolocation data, including the route, distance, speed and real-time location from your mobile device when you use location tracking;
device content and files (e.g., photos, audio, video or address book information on your device), which we may access with your consent to enable app features like voice interaction or social sharing; and
general technical data, such as your device information, browser type, operating system, IP address, device telephone number, software version, language setting, and device event information, including crash reports and system activity details).
We use cookies and other tracking technologies to collect and store technical and usage data, which may be linked to your account. For more information on our use cookies, please refer to Section 4 “Cookies and Similar Technologies.”
C. Social Interaction and Shared Content. When you use the social features in our Services (e.g., forums, message boards, chats, and other communication tools provided in our Services), we collect information about you, including:
your contacts and group information, including your contact list and details about the groups you create, join or are added to while using our app and related Services;
information about your interaction with other users (e.g., friend invitations and sharing of information or files with other users);
shared content, including posts, messages, voice chats, display names, profile photos, and other content you send through our Services; and
your messages, voice chats and real-time location shared with other users when you engaged in closed or open chats through our Services.
Information shared via social features will be visible to anyone who has access to our Services and may also be viewable outside of our websites or Services. Some of our app offer closed or open group chat functionality to facilitate communication among participants, including the sharing of each participant’s precise location with others in the group. You may not have control over who can join these group chat, and the communication may not be secure. You should exercise caution when using social features and other app services that are public in nature, as the information you share may be publicly visible and collected and used by third parties. This could lead to the disclosure of private information, for which we are not responsible.
D. Information We Receive from Third Parties: We may also receive information about you from third-party partners and businesses, (1) when you purchase or download our apps through third-party app stores, (2) if you sign into our Services using a third-party social media account (e.g., Google), (3) when you use or interact with third-party social features and plugins (such as Facebook “like”) integrated into our Services, or (4) when you make a purchase using third-party payment processors (e.g., PayPal, Venmo, and Shop Pay).
The information we receive may include:
Your name, photo, email address, phone number, date of birth, and other unique identifier;
Purchase information, including order details, payment information, and billing/shipping addresses;
Technical data, including your device information, identifier, IP address and account activity; and
Information from your third-party account, which may include account numbers, username, identity token, and other identity verification details.
We may merge this information with other data we collect to deliver personalized content (including advertisement), enhance your experience, improve our Services and for other purposes outlined in this Privacy Policy.
In addition, third parties (e.g., analytics providers, service providers, and payment processors) may use automated means to collect data about you and your device when you use our Services.
2. How We Use Your Information
We may use your personal and non-personal information for various business purposes, including to provide and improve our Services, fulfill your order, personalize your experience, and operate our business. We may also use your information for other purposes permitted by law.
To provide our products and services: We use your information, including personal information, to operate our business and provide our products and services to you. For example, we may use such information to:
carry out your order or other transactions that you have requested;
set up and administer your account, and maintain your transaction records;
provide access to our Services, including apps and other online services;
facilitate interaction between you and other users, including voice chats, text messages, and sharing real-time location data through our communication products and apps;
help you find and manage your friends list;
share content or information you post or send via the social features of our Services;
analyze usage trends to customize our content, layout, and services;
enhance the operation of our Services and improve our product and service offerings;
monitor our Services, including our websites, applications, and networks;
identify, troubleshoot and resolve bugs or other technical issues;
perform internal operation, including, to prevent fraud and abuse of our Services;
enforce our agreements with you, including the Terms and this Privacy Policy;
administer events, contests, sweepstakes, and promotions;
conduct surveys to better understand and serve our customers; and
fulfill other purposes you consent to or are notified of when we request your information or when you use our Services.
To provide customer support: We use your information to provide product and customer support. For example, we may use your information to:
respond to product or service issues, including warranty request;
resolve any dispute or issue;
notify you of safety recall, if applicable;
send order and shipping confirmation;
provide software updates for our products and apps; and
follow up and/or respond to inquiries submitted through our websites or other channels.
Commercial Messaging: We also use your information to send promotional materials and offers we believe may interest you, as well as improve our promotional offers. For example, we may send you newsletters, promotions, discount coupons, and updates about new product, service, or events.
Other legal purposes: We may also use your information for any other purpose as we determine, in our discretion, to be necessary or required to ensure the safety and/or integrity of our users, employees, third parties, public, and/or our Services, or to comply with requirements of any applicable law.
Retention of your information. In general, we retain your information for as long as necessary to fulfill the purposes for which it was collected and to provide our Services. Even if you close your account or we discontinue services, we may retain your information for our legal or legitimate business reasons, such as complying with our legal obligations, resolving disputes, preventing fraud or abuse, or enforcing our Privacy Policy and other agreements.
We may also anonymize or aggregate the information we collect and use or share such anonymized or aggregated information as permitted by applicable law.
3. With Whom We May Share Your Information
We may share your information in the following ways:
With other users and general public: You may share information with other users or the general public when you use the social features of our Services.
With the general public: Any information you upload, communicate, or otherwise make available in public spaces, such community message boards or public posts, will be accessible to everyone.
With other users of our apps: We offer apps for mobile device that enables app users to plan, share and track their ride information with other riders. Our apps (such as RideConnected, WAVE, Howling, etc.) may allow users to plan, share and track ride with other riders. These apps may enable features like group voice chats, precise location sharing, and route tracking with other app users. While these apps and features my offer some control over sharing, certain information will always be publicly visible to other users.
Your account profile, including nickname and profile photo, and any other information you choose to share publicly will be fully visible to all users, including users who are not your connection. Your profile and public posts can be searched and viewed by anyone.
You may be able to limit access to certain information to your “friends” (i.e. those with whom you connect). For example, you can adjust app settings to share your location and route data only with your friends. However, some social features, like open chat, are set to public by default, and any activities or information you share through these features will remain publicly accessible.
With other third parties: We may share your information with other third parties such as following.
We may share your information with our parent, subsidiaries or other affiliated companies.
We may share your information with contractors, service providers and other business partners who perform Services on our behalf or provide services and functionality.
We may share information where it is necessary to carry out your instruction. For example, to process a payment instruction, we must provide your personal information to our payment processors.
Our services may include third-party features (e.g., Facebook “Like” button or “Share” buttons). These third-party tools may collect information about you when you use our Services and are governed by the privacy policies of the third parties that provide them.
With your express consent, we may share your information with third parties for additional purposes. These third parties will use your information subject to their respective privacy policies.
We may share information about you if we reasonably believe that it is necessary to comply with, or is otherwise required by, any applicable law, regulation or legal process, or is necessary or appropriate to protect the rights, property or safety of Sena, our customers or others.
We may share your information with law enforcement, government authorities or other third parties as such disclosure is reasonably necessary (i) to investigate, remedy or enforce potential violation of Terms or this Privacy Policy, (ii) to protect the rights, property, and safety of us, our users, or others, or (iii) to uncover and resolve any fraud or security concerns.
In the event we undergo a business transaction, such as a reorganization, divestiture, merger, sale or dissolution (including bankruptcy), we may share your information with the relevant third party before and after the transaction closes.
Aggregated or anonymized data that do not identify you personally are not subject to this Privacy Policy, and we may use or share such information without limitation and for any purpose.
4. Cookies and Similar Technologies
From time to time, we may use the “cookies” and similar technologies that allow us to store a small piece of data on your computer or mobile device during your visit to our websites and other services.
We use cookies and similar technologies to enable you to sign in and to facilitate and customize your online experience. For example, we use cookies to deliver content specific to your location or interest, keep track of your shopping cart, store your preferences and other information to save you time and make your use of the site easier.
We also use cookies and similar technologies to help us learn how you use our Services over time. This information may be used to, among other things, analyze and track data, understand your online activity and determine which areas of our site are useful or need improvement.
Third parties may also use cookies on our Services. For instance, third party analytic services integrated into our Services will place cookies on your device to track and collect traffic data. We also utilize Facebook “Like” button and similar social tools of other social networks, including X, Instagram, and YouTube, who may themselves also put cookies on your device when you click the Like button or other similar links.
Please note that these third parties collect and use information under their own privacy policies, which we do not control. Please consult the respective privacy policies for these external services to understand their practice concerning privacy. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at our websites may be diminished and some features may not work as they were intended.
5. Third Party Sites and Services Accessible from Our Site
Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Our websites and Services may contain advertising or third-party services (such as the Facebook Like button or links to third party websites). These third-party websites accessible from our websites operate under their own privacy policies and have their own data collection, use and disclosure practices. Additionally, advertising or third-party services may collect information about you through the use of cookies, and we do not control this collection of information. If you visit a third-party website or use a third-party service, you should consult that site’s or service’s privacy policy. We are not responsible for the policies or practices of third parties.
6. Do Not Track Signal
We currently do not recognize or respond to Do Not Track (DNT) signals as no DNS standard has been adopted.
7. How We Keep Your Information Secure
The security of your personal information is important to us. We maintain appropriate technical and physical safeguards to help protect your personal information against unauthorized disclosure or access, destruction or alteration. However, no security measure is perfect, and for that reason, we cannot guarantee the security of your information. Therefore, you hereby agree to use our Services at your own risk. We do not assume the responsibility for the unauthorized use or access to your information under our control.
8. Notice Concerning Children
Our Services are intended for general audience and not directed at children under 13. We do not knowingly collect personal information from children under the age of 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. 9. Users Outside the United States
The information collected subject to this Privacy Policy is controlled by Sena in the United States. In addition, Sena may subcontract the processing of your data to or otherwise share your data with third parties, including outside service providers and business partners who may be located in the United States or countries other than your country of residence. This means that your information may be transferred to, stored and/or processed in the United States and other countries other than where you live. The data and privacy laws in these countries may not be as comprehensive as, and less stringent than, the laws in your country of residence. By using our Services, you expressly consent to your personal information being transferred to recipients in other countries and being store and processed in the servers located in other countries (including the United States) than your country of residence.
10. Your Choices Regarding Our Collection, Use and Disclosure of Your Information
We strive to provide you with choices regarding your personal information. The specific options available may vary depending on the Service you use.
Promotional messages from us. We may, from time to time, send you e-mail or direct mail about our products and services that we believe may interest you. Only Sena (or a marketing service provider working on behalf of Sena) will send you these messages. If you do not want to receive these communications, you can opt-out by sending us your request via email to privacy@sena.com. You can also unsubscribe from our marketing emails by clicking the unsubscribe link included in those emails.
Location Information. You can choose whether or not to allow the app to collect and use real-time location information from your device through the device's privacy settings. If you block the use of location information, some parts of the app may become inaccessible or not function properly.
Tracking technologies. You also have choices with respect to cookies, as described below. By modifying your browser settings, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Services may become inaccessible or not work properly.
Residents in certain states and countries may have additional privacy rights and choices. Please see Section 11 “Your Privacy Rights” and other state or country specific notices provided in this Privacy Policy for more information.
11. Your Privacy Rights.
Consumer privacy laws may provide their residents specific rights regarding their personal information. Depending on where you live, you may have some or all of the following rights:
The right to access / data portability. You may request, up to twice in a 12-month period, to access the personal information that we collected about you, including the categories of information collected and the sources, the business purpose for collecting or sharing your information, and the third parties with whom we may share your data. You may also request a copy of your personal information we collected about you in a commonly used and machine-readable format (also called a data portability request). Disclosure of certain information may be exempt under the applicable laws.
The right to delete certain personal information. You may request the deletion of your personal information, subject to certain legal exceptions. For example, we may deny your deletion request if retaining the information is necessary for us or our service providers to provide services that you requested, protect against fraudulent or illegal activities, comply with a legal obligation or make other internal and lawful uses permitted under the law. We will delete or deidentify personal information not subject to one of such exceptions from our records and will direct our service providers to take similar action.
The right to correct inaccuracies. You may request the correction of any inaccurate or incomplete personal information we have about you.
The right to restrict certain processing. You may request that we restrict the processing of your data under certain circumstances, such as when the accuracy of your data is disputed, the processing is unlawful, or the data is needed for the exercise of defense of legal claims.
The right to object. You may have the right to object to our processing of your personal data for direct marketing, research or statistical purposes, or processing based on certain legal grounds such as processing necessary for our or a third party’s legitimate interest or performing a task in the public interests.
The right to opt-out of automated individual decision-making, including profiling. Certain state residents have the right to opt-out of automated decision-making or profiling in furtherance of decision that produces legal or similarly significant effects. We currently do not engage in “profiling” with such purpose or effect.
The right to nondiscrimination. We will not discriminate against you for exercising any of your privacy rights. Unless permitted by the law, we will not deny, charge different prices for, or provide a different level or quality of goods or services for choosing to exercise such rights. However, we may offer you certain financial incentives permitted under applicable laws that can result in different prices, rates, or quality levels

When submitting request, you must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information. You do not need to create an account with us to submit a request to know, correct or delete.
Account holders: If you submit a request through your password-protected account, we consider the request sufficiently verified when the request relates to personal information associated with that specific account.
Non-accountholder: We may ask you to confirm unique details we have about you or your device to verify your identity.
We will send our response through your account, if you have one. If you do not have an account, we will deliver our response via your preferred method—either electronically or by mail.
Authorized Agents. You or someone legally authorized to act on your behalf may exercise your rights. If your agent submits a request on your behalf, we may require you to confirm directly with us your identity and your designated agent’s authority to submit the request for you unless you have provided your agent with a valid power of attorney duly executed under applicable law.

12. Privacy Notice for California Residents
This Privacy Notice for California Residents supplements the information contained in our Privacy Policy and applies solely to visitors and users who reside in the State of California.
A. Notice at Collection.
We collect your personal information and sensitive personal information to support our business operations, including the business purposes described in Section 2 “How We Use Your Information.”
Depending on how consumers use our Services, we may collect the following categories of personal information from consumers in California.
(a) Identifiers, such as name, address, email address, phone number, IP address, social media account, identity provider token, identifier, store account username, and device identifier.
(b) Customer records, such as name, identity verification details, birthdate, payment information, billing and shipping addresses, purchase and warranty records, and correspondence with us.
(c) Account details, including Sena account information with password and other login details.
(d) Commercial information, including products viewed, searched or purchased, and other order, payment and transaction records.
(e) Internet or network activities, such as use of our Services, including our apps and websites, web pages viewed and users’ interaction with online content.
(f) Geolocation data, including users’ real-time precise location, route, distance, travel time and speed of travel.
(g) Technical data about a user’s device, software, and system, including, device identifier, operating system, browser type, language setting, applications installed, the device’s telephone number, and device event information, including crash reports and system activity details.
(h) User profile information, including user display name, photo and any other information that a user may choose provide or share.
(i) Use posted content and information that users post, publish or display on our websites or other parts of our Services.
(j) Content of users’ text messages and chats with others and other interactions and sharing of information between users through our Services.
(k) Inferences from users’ personal information, including your profile and preference.
(l) Stored device content and files, including photo, audio, video, and personal contacts and address book information on users’ devices or apps.
We do not sell your personal information, including any sensitive information, or share it with third parties for purpose of targeted advertising.
In general, we retain your personal information for as long as necessary to fulfill the purposes for which it was collected and to provide our Services. We may retain your personal information even after you have closed your account with us or we have ceased providing Services to you, if retention of your information is reasonably necessary for our legal or legitimate business reasons.

B. Additional Information for California Residents.
Personal Information Categories. In the preceding 12 months, we have collected the same categories of personal information listed in the preceding Section 12.A. from California consumers when they used our Services (as defined in this Privacy Policy).
We obtained the personal information listed above from the sources listed in Section 1 “What Information We Collect.”
We may use or disclose the personal information we collect for one or more of the business purposes described in Section 2 “How We Use Your Information.”
Disclosure of Personal Information. In the preceding 12 months, we have disclosed the following categories of personal information to the third party categories indicated in the chart below for one of more business purposes outlined in Section 2 “How We Use Your Information.”

We have not sold or shared the personal information of California consumers for the purpose of targeted advertising in the preceding 12 months, and we do not have actual knowledge of any sale of personal information belonging to California consumers under the age of 16.
Sensitive Personal Information. Sensitive personal information is a subtype of personal information consisting of specific information categories. While we collect some data that fall within this information categories, we use it only for the limited purposes that do not require us to offer the option to limit our use of such information.
Your rights and choices. The California Consumer Privacy Act (“CCPA”) provides California residents with specific rights concerning their personal information, including: (1) the right to access your personal information, (2) the right to delete certain personal information, (3) the right to correct inaccurate personal information, and (4) the right not to receive discriminatory treatment for exercising your privacy rights under the CCPA. Please see Section 11 “Your Privacy Rights” to understand how to exercise the above rights.
Notice of Financial Incentives
We offer consumers financial incentives in the form of discount coupons, promotional offers, or other benefits when they provide their email addresses and opt-in to receive marketing communications from us.
The financial incentive reflects the value of your personal information to us, which we estimate is reasonably related to the discounts or benefits you receive. The method of calculating the value may include: (a) cost related to maintaining the marketing program, and (b) profits generated by collection or retention of consumer data.
To participate in our discount coupon program, you must provide your email address and consent to receive marketing communications from us. You can opt in by signing up through our online subscription form. When you sign up by providing your email address, we may provide coupons, exclusive offers, updates, and relevant promotions tailored to your interests.
Participation in the program is voluntary. If you no longer wish to participate or receive emails, you may opt out at any time by: (1) clicking the "Unsubscribe" link at the bottom of any marketing email; or (2) contacting us by email at: privacy@sena.com
We will not discriminate against you for exercising any of your rights under the CCPA. However, if you choose to opt out of receiving promotional offers, you will no longer receive the discount offers or promotional coupons tied to the program.
c. Privacy Rights for California Minors.
California residents under the age of 18 have the right to request the removal of any content or information they have posted on our Services, such as public forums or message boards. To make a removal request, please contact us at privacy@sena.com.
Please note that the removal of your content or information may not be complete or comprehensive, and residual copies of such removed information or content may remain on our servers. In addition, we are not obligated to remove content or information that has been copied or reposted by a third party, has been rendered anonymous, or must be retained to comply with legal obligations.

13. Additional Information for EEA and UK Residents.
Legal basis for processing your personal information. The legal basis for processing your personal information depends on the type of information, the context of its collection, and your location. If you reside in the European Economic Area (“EEA”), United Kingdom (“UK”), or a jurisdiction with similar legal requirements, we process your personal information based on one or more of the following legal grounds:
Consent: When you consent to the processing of your personal information, including for example: when you register an account or download our apps, and when you sign up for our newsletters, offers, and other promotional events or communications.
Performance of a Contract: When the processing is necessary for performing a contract with you or to take steps at your request, including, for example: (i) to facilitate product purchases, process payments, and deliver goods your ordered; (ii) to provide customer support and warranty services; (iii) to provide our Services and other features that you may request or enable; and (iv) to perform and enforce the terms of our agreements with you, including our Terms of Services.
Legal Obligation: When the processing is necessary to comply with a legal obligation, including a court order, subpoena, or any other applicable laws.
Protection of Vital Interests: When the processing is necessary for protecting the vital interests of you or another natural person, including, for example: (i) to prevent and respond to any fraud, abuse, or other unlawful activities that may harm out users or other natural persons.
Legitimate Interests: When the processing is necessary for our (or a third party’s) legitimate interests, provided these interests are not overridden by your interests or fundamental rights and freedoms. For example, (i) to analyze trends, enhance customer experience, and improve and develop our Services; and (ii) to detect and resolve any bug, security vulnerabilities and technical issues.
Your rights under the General Data Protection Regulation (“GDPR”).
As an EEA or UK resident, you have the right to request access to, correct, and erase the personal data that we hold about you, or object to the processing of your personal data under certain circumstances.
If you have provided your consent to the collection, processing, and transfer of your personal data, you may have the legal right to withdraw your consent under certain circumstances.

If you have any question or concern about our processing of your personal data or would like to make an access or other request, you can always contact us. But, if you have any unresolved concern, you also have the right to make a complaint with the data protection authority in your jurisdiction.
14. Changes to This Privacy Policy
From time to time, we may update this Privacy Policy to clarify our practices or to reflect new or different privacy practices, such as when we introduce new features or services.
